Smart Fuel Affiliate Terms & Conditions

1. Overview

These Affiliate Terms & Conditions (“Terms”) govern participation in the Smart Fuel Affiliate Program (the “Program”).

By applying to or participating in the Program, you agree to comply with these Terms and all applicable laws and regulations.

2. Independent Contractor

Affiliates are independent contractors and are not employees, agents, partners, or representatives of Smart Fuel.

Nothing in these Terms creates any partnership, joint venture, or agency relationship.

3. Prohibited Claims

Affiliates may NOT:

  • Make medical or health claims

  • State or imply that Smart Fuel products diagnose, treat, cure, or prevent any disease

  • Reference medical conditions (including but not limited to ADHD, depression, anxiety disorders, or chronic fatigue)

  • Guarantee results or make misleading performance claims

  • Make income or financial outcome claims tied to the product

Permitted examples include:

  • “Supports focus and productivity”

  • “Helps provide clean energy”

  • “Supports mental clarity”

FDA Disclaimer Requirement

When making permissible structure/function claims (e.g., supports focus, mental clarity), affiliates must include the following disclaimer where applicable:

“These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.”

4. FTC Disclosure Requirements

Disclosures are required in all promotional content, including social media posts, videos, emails, landing pages, and any other marketing materials.

Acceptable disclosures include:

  • “This is a paid partnership”

  • “I may earn a commission from this link”

Disclosures must be easy to understand, visible, and not hidden.

5. Content Responsibility

Affiliates are solely responsible for all content they create and distribute.

Smart Fuel is not responsible for any statements, claims, or representations made by affiliates.

6. Use of Brand Assets

Affiliates may only use approved Smart Fuel branding and materials.

Affiliates may NOT:

  • Modify logos or branding

  • Misrepresent Smart Fuel

  • Use deceptive or misleading marketing practices

7. Paid Advertising Restrictions

Affiliates may NOT:

  • Bid on branded keywords (e.g., “Smart Fuel”)

  • Create ads that impersonate or appear to be the official brand

  • Use misleading landing pages or funnels

8. Commission Terms

Commissions are tracked, calculated, and paid through our third-party affiliate platform (Superfiliate or Impact) and are subject to that platform’s payment schedule and terms. All commissions are subject to verification and approval prior to payout.

Smart Fuel reserves the right to:

  • Approve or deny commissions at its sole discretion in cases of suspected fraud, abuse, policy violations, or invalid traffic

  • Withhold commissions in cases of suspected fraud, abuse, or policy violations

  • Reverse commissions associated with refunded, returned, or charged-back transactions

  • Adjust commission structures at any time

9. Prohibited Conduct

Affiliates may NOT:

  • Purchase products through their own affiliate links

  • Engage in self-referrals or fraudulent transactions

  • Use deceptive, misleading, or incentivized traffic methods

  • Attempt to manipulate tracking, cookies, or attribution systems

10. Monitoring and Enforcement

Smart Fuel reserves the right to monitor affiliate activity.

We may require modification or removal of any content at any time, for any reason.

Affiliates agree to comply promptly with all such requests.

Failure to comply may result in suspension, termination, and/or forfeiture of commissions.

11. Termination

Smart Fuel may terminate participation in the Program at any time, with or without notice or cause.

Upon termination, affiliates must immediately cease use of all Smart Fuel branding, links, and promotional materials.

12. License to Use Content

By participating in the Program, you grant Smart Fuel a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, distribute, and display any content you create related to Smart Fuel for marketing, advertising, and business purposes, without additional compensation.

13. No Authority

Affiliates have no authority to make representations, warranties, or commitments on behalf of Smart Fuel.

Affiliates may not present themselves as employees, agents, or official representatives of the company.

14. Compliance With Laws

Affiliates agree to comply with all applicable laws, regulations, and platform rules, including but not limited to:

  • Federal Trade Commission (FTC) guidelines

  • Advertising and marketing laws

  • Platform-specific policies (e.g., TikTok, Meta, YouTube)

15. Indemnification

Affiliates agree to indemnify, defend, and hold harmless Smart Fuel and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from:

  • Affiliate content

  • Violations of these Terms

  • Violations of applicable laws

16. Limitation of Liability

To the fullest extent permitted by law:

  • Smart Fuel shall not be liable for any indirect, incidental, consequential, or punitive damages arising from participation in the Program

  • Smart Fuel’s total liability shall not exceed the greater of:

    • The total commissions paid to you in the preceding 12 months, or

    • $100

17. Arbitration and Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved in accordance with the arbitration provisions set forth in the Smart Fuel Terms of Service. By participating in the Program, you agree to be bound by those arbitration provisions.

18. Modifications

Smart Fuel reserves the right to modify these Terms or the Affiliate Program at any time.

Continued participation constitutes acceptance of any changes.

19. Governing Law

These Terms are governed by the laws of the State of Florida.

20. Survival

Any provisions that by their nature should survive termination, including but not limited to indemnification, limitation of liability, and content license rights, shall remain in effect.
