Smart Fuel Affiliate Compliance Guidelines

1. Overview

These guidelines apply to all Smart Fuel affiliates and partners.

They are designed to ensure compliant promotion while protecting both you and the company. Following these guidelines will help you promote Smart Fuel confidently and responsibly.

2. Claims and Messaging Rules

Affiliates may NOT:

  • Make medical or health claims

  • State or imply treatment, cure, or prevention of any disease

  • Reference medical conditions (ADHD, depression, anxiety, etc.)

  • Compare Smart Fuel to prescription drugs

Permitted language includes:

  • Supports focus and productivity

  • Helps provide clean energy

  • Supports mental clarity

All statements should be general, non-medical, and experience-based.

3. Testimonials and Results

Affiliates may share personal experiences, but must:

  • Avoid guaranteeing results

  • Avoid implying typical or universal outcomes

  • Avoid income or financial outcome claims tied to the product

Individual experiences may vary.

FDA Disclaimer Requirement

When making structure/function claims (e.g., supports focus, mental clarity), affiliates must include the following disclaimer where applicable:

“These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.”

4. FTC Disclosure Requirements

Disclosures are required in all promotional content, including social media posts, videos, emails, landing pages, and any other marketing materials.

Examples include:

  • “Paid partnership”

  • “Affiliate link”

  • “I earn commissions from this”

Disclosures must be easy to understand and not hidden or difficult to find.

5. Usage and Safety Positioning

Affiliates should generally align with product guidance:

  • Start with 2 capsules

  • Up to 4 capsules daily

Avoid recommending:

  • Excessive usage

  • Combining with other high-stimulant products (e.g., energy drinks or pre-workouts)

Content should reflect responsible and informed use.

6. Content Responsibility

Affiliates are solely responsible for ensuring that their content complies with all applicable laws, regulations, platform policies, and these guidelines. Smart Fuel is not responsible for any statements or claims made by affiliates that are inconsistent with these requirements.

7. Content Monitoring and Removal

Smart Fuel reserves the right to request modification or removal of any content at any time, for any reason.

Affiliates agree to comply with such requests promptly.

8. Prohibited Conduct

Affiliates may NOT:

  • Engage in deceptive or misleading marketing

  • Use incentivized, fraudulent, or manipulative traffic methods

  • Misrepresent the product or brand

  • Bid on branded keywords (e.g., “Smart Fuel”) in paid search without prior approval

  • Use unsolicited email or SMS marketing

  • Use misleading redirects, cloaking, or cookie stuffing

9. Content Usage Rights

By participating in the program, affiliates grant Smart Fuel a worldwide, royalty-free, perpetual license to use, reproduce, modify, and promote their content for marketing and business purposes, without additional compensation.

10. Enforcement Framework

Our approach is collaborative, but structured:

  • First issue: Request for correction

  • Repeated issues: Content removal and potential commission impact

  • Continued violations: Termination from the program

11. Relationship to Affiliate Terms

These guidelines are in addition to, and do not replace, the Smart Fuel Affiliate Terms & Conditions.

Affiliates are responsible for complying with both documents.
